Terms of use and sale
Last updated 23 October 2026 · version 4
These terms apply when you use the Capasithé website and when you buy from us. Please read them before you order: at checkout you confirm that you accept them, and we record which version you accepted.
Who we are
Capasithé is the trading name of КАПАСИТЕ ЕООД (CAPASITHE LTD), a company registered in Bulgaria under company number (ЕИК) 208967625, with its registered address at zh.k. Druzhba 1, bl. 195, vh. V, et. 4, ap. V44, 1592 Sofia, Bulgaria. In these terms “we” and “us” mean КАПАСИТЕ ЕООД (CAPASITHE LTD), and “you” means the person or business using the site or buying from us. Our full details are in the legal notice.
You can reach us at support@capasithe.com. We answer in English and in Bulgarian.
In these terms “boxes” means everything we make for you, decorated jars included. Some rules here apply only to consumers, meaning people who buy for purposes outside their trade, business or profession, and some only to businesses. Where a rule applies to only one of them, we say so.
Your account
You can design boxes without an account. To keep your designs on every device, to order and to follow your orders, you sign in with your email address and a one-time code we send to it. The first sign-in with an address opens your account under these terms, and our privacy policy says how we look after your data.
Keep your mailbox safe: whoever can read your email can sign in to your account. Tell us at once at support@capasithe.com if you think someone else has signed in.
You may close your account at any time by writing to us. We may suspend or close an account that is used to break the law or these terms, and we tell you why. Orders already paid are then completed or refunded in full.
Your designs and files
You keep every right you have in the designs, pictures, logos, text and files you make or upload (“your content”).
You confirm that you own your content or have permission to use it, including any trademark, picture, typeface and text in it, and that putting it on boxes and sending the boxes to you breaks no law and no one else's rights.
You allow us to store, copy, adapt and print your content, and to show it to you and to the people who work on your order, only as far as we need to make, show and deliver your designs and orders and to keep the records the law requires. We use your content for nothing else, such as our own advertising, without asking you first.
We may refuse or cancel an order, and remove content from our systems, if the content is unlawful or clearly infringes someone else's rights, for example counterfeit branding or hateful material. If you have already paid, we refund you in full.
If someone claims that boxes made from your content infringe their rights, we tell you. A business customer covers the costs and damages such a claim causes us when the claim arises from content the business provided.
You may use the starter designs, pictures and typefaces we offer in the editor on the boxes you order from us.
The proof
Before you pay, we show you the proof of your order: every side of the box as it will be printed, with its size and its finishes. Check it carefully, including the spelling, the colours you chose, the size and where everything sits on the box.
When you approve the proof, you confirm that it is what you want, and we make your boxes as the approved proof shows them. We do not correct mistakes in your content that the proof shows, such as a misspelling or a picture placed across a fold.
Placing an order
Your order is the box, the quantity, the finishes, the design on the approved proof and the delivery address, at the total shown at checkout. The total includes the boxes, delivery and any VAT.
The contract between us is made when your payment succeeds. We then confirm the order by email with its details, and you can see it at any time under My boxes.
If an order carries an obvious error in its price, or we cannot make it as ordered, we tell you before we make it, and you may cancel it for a full refund.
Prices and VAT
All prices are in euros. The configurator and the editor show the price as you design; checkout confirms the total before you pay, and that total is what you pay.
Prices for consumers include VAT: the VAT that applies to delivery to your address, whose rate and country checkout names. If you deliver to another country than the one prices were shown for, checkout shows the total for your address and says why it changed.
Prices for businesses are shown without VAT, and checkout adds VAT where it applies. A business in an EU country other than Bulgaria that gives a VAT number of the country it takes delivery in pays no VAT once the European Commission's VIES service confirms the number: the business accounts for the VAT itself under the reverse charge. If VIES cannot be reached at checkout, the order is charged VAT, and we refund that VAT once VIES confirms the number.
Deliveries outside the European Union carry no VAT from us. The country of delivery may charge import duties, taxes and fees, which the recipient pays.
Your invoice states the VAT charged with its rate and its country, or the reason no VAT was charged.
Payment
You pay in full when you place the order, by card, on a payment page run by our payment provider, Stripe. Your card details go to Stripe and never reach us.
We charge in euros. If your card is in another currency, your bank converts the amount and may charge a fee for it.
A refund goes back to the card you paid with. We start it within 14 days of the day it is due; your bank may take a few more days to show it.
For every payment we email you an electronic invoice, which takes the place of a fiscal receipt; for every refund, a credit note.
Pre-orders
Until production opens, every order is a pre-order: you order and pay now, and we make and ship your boxes when production opens.
A pre-order costs 15 % less than the price of its boxes. The discount does not apply to delivery, and checkout shows it as a line of its own.
We ship your pre-order by 31 January 2027 at the latest. Checkout states this date, and you agree to it when you place the order.
Until we start making your boxes, you can cancel the pre-order from its page or by writing to us, and we refund everything you paid. Once we have started making them, the pre-order can no longer be cancelled, because the boxes are made to your design.
If we have not shipped your boxes by 31 January 2027, you may cancel the pre-order at any time after that day, even if we have started making them, and we refund everything you paid. If we see that we cannot keep to the date, we tell you by email.
Delivery
We deliver to the countries offered at checkout, by courier or by post. Delivery is priced by the weight of your order and shown before you pay. For a pre-order, the date in “Pre-orders” applies; for any other order, checkout shows when we expect to ship.
For a consumer, the risk of loss or damage passes when you, or someone you name other than the carrier, receive the boxes. For a business, it passes when we hand the boxes to the carrier.
When the parcel arrives, look it over. If it is damaged, please tell the courier, take photos and write to us as soon as you can, so that we can claim from the carrier. This does not shorten your rights under the legal guarantee.
If a parcel comes back to us because the address was wrong or nobody collected it, we may charge the cost of sending it again.
Cancelling and the right of withdrawal
Consumers in the EU usually have 14 days to withdraw from an online purchase without giving a reason. That right does not apply to goods made to the consumer's specifications or clearly personalised (Article 16(c) of Directive 2011/83/EU; in Bulgaria, Article 57, point 3 of the Consumer Protection Act). Everything we sell is made to order, to the size, the finishes and the design you choose, so the right of withdrawal does not apply to it. Checkout asks you to confirm that you know this before you pay.
You can still cancel a pre-order as “Pre-orders” says, and your rights when boxes are faulty stay as they are.
What to expect from your boxes
Boxes are made of board, which has a grain, a thickness and a texture of its own. A screen shows colours in light and board shows them in ink, so a colour can look different on board than on your screen. Two runs of the same design can differ slightly in colour, and the cut and the folds can sit a fraction of a millimetre from where the proof draws them. This is why the editor shows a safe area for text and a bleed beyond the edges: content placed as the editor advises comes out as the proof shows it.
Differences like these are not a fault. A difference that makes the boxes clearly unlike the approved proof, or unfit for their purpose, is a fault, and the legal guarantee covers it.
If something is wrong: the legal guarantee
We are responsible to a consumer for any lack of conformity of the boxes with the order and the approved proof that exists when they are delivered and shows within two years of delivery. This is the legal guarantee of conformity that EU and Bulgarian law give consumers.
A business checks the boxes when they arrive and tells us of a visible fault within 14 days of delivery, and of a fault that could not be seen on delivery as soon as it is found, within six months of delivery at the latest.
If the boxes are not in conformity, we first reprint them free of charge, delivery included. If a reprint is impossible, would cost us disproportionately more, cannot be done within a reasonable time or does not cure the fault, you may choose a proportionate reduction of the price or, for a fault that is not minor, a full refund of what you paid for the faulty boxes.
The guarantee does not cover what the approved proof shows, such as a misspelling in your content, damage from misuse after delivery, or the normal differences described in “What to expect from your boxes”.
Complaints
Write to support@capasithe.com with your order number, what is wrong and, where they help, photos. We confirm your complaint within 3 working days and settle a justified complaint within one month of receiving it, unless we agree a longer time with you.
We may ask you to send back a few of the faulty boxes, at our cost.
Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, for intent or gross negligence, or any liability the law does not allow us to limit, and nothing in them takes away a consumer's rights under the law.
Towards a business, our liability for an order is limited to the price paid for it, and we are not liable for lost profit, lost business or any other indirect loss.
We are not responsible for a delay or failure caused by events beyond our reasonable control, such as natural disasters, strikes, the failure of a carrier or a supplier, or an outage of the internet. We tell you as soon as we can, and if such an event delays an order by more than 30 days, either of us may cancel it, and we refund what you paid for anything not delivered.
Law and disputes
These terms and every contract under them are governed by Bulgarian law. A consumer who lives in another country also keeps the protection that the mandatory law of that country gives them.
If we cannot settle a complaint between us, a consumer may turn to the General Conciliation Commission for Sofia at the Commission for Consumer Protection (КЗП), which helps consumers and traders settle disputes out of court (kzp.bg). The legal notice gives its details.
A consumer may bring a claim before the courts of the country they live in or before the Bulgarian courts. A dispute with a business goes to the competent court in Sofia, Bulgaria.
We publish these terms in English and in Bulgarian. If the two versions differ, the Bulgarian version prevails.
Changes to these terms
We may change these terms, for example when the law changes or when we offer something new. A new version applies from the day we publish it here, to orders placed from then on: an order keeps the version accepted at its checkout. The date and the version of the text in force are at the top of this page.
